Welcome to DriBrush. This website, dribrush.com (the "Site"), is operated by DriBrush ("we", "us", "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), including any additional terms and policies referenced here, such as our Privacy Policy, Shipping & Delivery, and Refund & Guarantee Policy. If you don't agree, please don't use the Site.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that lets us sell to you.

1. Using the Site

You must be at least the age of majority in your state or country of residence, or have consent from a parent or guardian, to use the Site. You may not use our products for any illegal purpose or violate any laws in your jurisdiction. You may not transmit malicious code or attempt to interfere with the Site's operation. A breach of these Terms may result in immediate termination of your access.

2. Products

DriBrush is a UV sanitizing and drying station for toothbrushes. It is a household hygiene device, not a medical device, and it does not diagnose, treat, cure, or prevent any disease. Results vary by household and use. We make every effort to display our products accurately, but we can't guarantee your screen shows colors exactly. We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.

3. Safety

Use DriBrush only as directed. The UV light operates only while the lid is closed. Do not attempt to bypass the lid, open the unit during a cycle, disassemble the device, or look directly at the UV source. Keep out of reach of small children except when supervised. Do not submerge the unit in water. Charge only with a standard USB-C cable and a certified USB power adapter.

4. Orders, Pricing, and Payment

Prices are shown in the currency selected at checkout and may change without notice. Promotional pricing, including any percentage-off offers, applies only while displayed on the Site. We reserve the right to cancel any order, including for suspected fraud, pricing errors, or stock issues, in which case you'll be refunded in full. You agree to provide accurate, current, and complete purchase and account information. Payment is processed by third-party providers; we never store full card numbers.

5. Shipping

Shipping times, regions, and customs responsibilities are described on our Shipping & Delivery page, which forms part of these Terms. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery, subject to our lost-package promise on that page. International customers are responsible for any import duties, taxes, or fees charged by their country.

6. Refunds and Guarantee

Our 30-Day Money-Back Guarantee and all refund, cancellation, and replacement terms are set out on our Refund & Guarantee Policy page, which forms part of these Terms. The guarantee is limited to one order per customer.

7. Accuracy of Information

Information on the Site is provided for general purposes and may contain errors or be out of date. We reserve the right to correct errors and update information at any time without prior notice, but we have no obligation to do so.

8. Intellectual Property

The DriBrush name, logo, product designs, images, text, and all other content on the Site are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from them without our written permission.

9. User Content

If you send us reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, edit, publish, and distribute it in any medium. You represent that your content is your own, is accurate, and doesn't violate anyone's rights. We may remove content we consider unlawful, offensive, or otherwise objectionable at our discretion.

10. Third-Party Links and Tools

The Site may link to third-party sites or provide access to third-party tools. We don't control and aren't responsible for them. Use them at your own risk and review their terms.

11. Disclaimer of Warranties

Except as expressly stated in our guarantee, the Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Site will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, DriBrush and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions don't allow these limitations, in which case our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless DriBrush and its affiliates, officers, employees, and partners from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Nothing here limits any consumer protection rights you have under the mandatory laws of your country of residence.

15. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of it.

16. Entire Agreement

These Terms, together with the policies referenced here, are the entire agreement between you and us regarding the Site and supersede any prior agreements.

17. Changes to These Terms

We may update these Terms at any time by posting changes on this page. Continued use of the Site after changes are posted means you accept them.
